1. Provider and scope
The provider is Arber Gashi, an independent software developer in Lucerne, Switzerland. Contact details are available in the pro-business.ch imprint. These terms cover paid Takt Pro plans requested directly through pro-business.ch and paid to us.
Separate terms apply to ewws. Industrie Charts is available under the MIT licence; optional support is agreed separately. Purchases through third-party sales platforms follow the ordering and payment process and the terms presented there.
-
2. Theme and open-source licence
Takt Standard and Takt Pro are licensed under GNU GPL version 2 or later. A purchase and these terms do not restrict the rights in the theme code granted by that licence, including permitted redistribution and modification.
Payment covers the selected Pro plan, with access to updates and support for the agreed number of websites and term. A licence key controls access to these services, not the copyright licence for the GPL code.
-
3. Plans and included services
Takt Pro includes service access for one website. Agency plans cover five or ten websites and one central support contact. The selected plan, final price shown during the order process and subsequent individual invoice determine the order.
The product page describes features and system requirements. Custom design, migration, installation, hosting or ongoing maintenance of the customer's website are not included unless separately agreed in writing.
-
4. Request, contract and payment
The online form first sends a non-binding order request. Its acknowledgement is neither acceptance nor an invoice. We review the information and send an individual offer in the form of an invoice with the provider's full postal address before payment. The Pro plan contract is formed when that invoice is paid. No Pro service access is activated without payment.
The final price and currency follow the billing address: CHF for Switzerland, EUR for the rest of Europe and USD outside Europe. The displayed final price includes any applicable taxes. Payment details and the due date appear on the invoice; no card details are collected.

5. Term, delivery and renewal
Updates and support run for twelve months from confirmed receipt of payment. The licence key for the paid plan is delivered after that confirmation. There is no automatic renewal or automatic charge. A further term requires a new order and payment.
The installed theme and the customer's content remain usable after expiry. Entitlement to new Pro updates and support ends unless a new term is agreed. Statutory rights are unaffected.
-
6. Updates and support
During the paid term, we provide the Pro updates and product-related support included with the plan. Support covers installation, use and reproducible Takt Pro defects. Custom development, third-party plugins, hosting and customer modifications are excluded unless otherwise agreed.
A fixed response or resolution time applies only if individually agreed in writing. Security and feature updates may require minimum WordPress, PHP or WooCommerce versions; check the published requirements before installation.
-
7. Withdrawal for consumers
Mandatory statutory withdrawal rights remain unaffected. Consumers who have such a right may use the statutory period; for applicable EU distance contracts this is generally 14 days from contract formation. Withdrawal requires no reason and can be declared clearly by email to gashi@pro-business.ch. Sending the declaration before the deadline is sufficient.
An optional model statement is: “I withdraw from the Takt Pro contract ordered on [date], order number [number], name and address [details], date [date].” Use of this wording is not required. If withdrawal is effective, payments received will be refunded under the applicable statutory rules.
The order process does not ask consumers to waive a statutory withdrawal right. Delivering the licence key alone does not amount to such a waiver. Where no statutory withdrawal right exists, these terms do not grant an additional voluntary one.
-
8. Defects, responsibility and privacy
Applicable statutory remedies govern defects. Mandatory liability rules, especially for intentional misconduct, gross negligence and personal injury, remain unaffected. Responsibility for a site's own content, backups and WordPress operation rests with its operator to the extent permitted by law.
Order, licence key and support data are processed as explained in the pro-business.ch privacy notice. The theme itself runs in the customer's own WordPress installation.
-
9. Governing law and changes
Swiss law applies to business customers, with Lucerne as the place of jurisdiction where legally permitted. Mandatory consumer protections and competent courts in a consumer's country of residence remain unaffected.
The version available before the contract was concluded applies. Later changes do not retroactively alter an already paid term. Individually confirmed written agreements take precedence.
